On this page, we'll try to keep the site updated with pending bills relating to fixing the Insurrection Act.
As of the latest update, there are three recently-introduced bills that address these issues. They are:
S.B. 3902 (introduced by Senator Blumenthal of Connecticut)
H.R. 7135 (introduced by Representative Omar of Minnesota) (parallels S.B. 3902)
H.R. 7124 (introduced by Representative Brown of Maryland)
H.R. 7215 (introduced by Representative Keating of Massachusetts)
The text of these bills is posted below. Note that H.R. 7135 is essentially the same as S.B. 3902. The key statutory change in these two bills is to require that the President make various certifications to Congress in connection with the domestic use of the military.
H.R. 7124 takes a different approach, banning the use of the military under the Insurrection Act except in cases where the President has declared a national emergency, with the use of the military tied to the nature of the emergency declared.
H.R. 7215 would require the President to notify key Congressional leadership before troops are deployed under the Insurrection Act, and would automatically terminate an authorized deployment after 14 days, unless Congress specifically enacts a law or resolution extending the deployment.
